1. These Terms, Conditions, and Supplementary Policies govern your access to the website www.thatek.com and the Thatek mobile applications on Google Play and Apple App Store, as well as your access to and use of any content, services or assessments. (collectively referred to as the “Services”).
2. Please read these Terms, Conditions, Policies, Rules, and Guidelines related to your use of the Services (collectively referred to as “Our Terms”) to ensure that you understand each provision before using Thatek’s Website and Applications, as they affect your legal rights. By accessing or using any part of the Website, Applications, or Services, you agree to be bound by these Terms. If you do not agree to these Terms, Policies, and any subsequent amendments thereto, please refrain from accessing our Services.
3. Thatek Platform reserves the right to modify, update, or change these Terms from time to time at its sole discretion and will. You must review them regularly to stay informed of any updates. Your continued use of Thatek’s Website, Applications, and the Services available through them constitutes your express agreement to be bound by the amended and applicable Terms at the time of your use. You acknowledge our right to:
   1. Amend or modify these Terms, Conditions, and other Policies.
   2. Deny any user access to the Website or Mobile Applications.
   3. Terminate or suspend accounts that violate applicable Terms, Policies, or Laws without prior notice.
   4. Deactivate your username and password at any time.
   5. Make changes to the Applications or impose additional fees for Services, and you will be duly notified.
   6. Modify, terminate, or block the Website and Applications, whether permanently or temporarily.

Definitions

Unless the context otherwise requires, the following terms shall have the meanings set forth next to each:

1. “Platform,” “We,” “Us,” “Our”: refer to the Thatek brand, and all pages, tools, and services available through it.
2. “User,” “You,” “Your”: refers to any person who visits the Website or uses any of our Applications or Services in any manner, whether as a subscriber or otherwise.
3. “Assessment”: refers to the self-development assessments provided by the Platform.
4. “Contract,” “Agreement”: refer to these Terms and Conditions and all other supplementary Policies, Rules, and Instructions published on the Website and Applications.
5. “Laws”: refer to the laws and regulations in force in the Kingdom of Saudi Arabia.

Legal Nature of the Terms

1. This Agreement constitutes a fully valid and enforceable contract against you. By using the Platform, you acknowledge that you have reviewed this Agreement and are bound by it as if you had signed a written contract.
2. This Agreement has been drafted in accordance with the laws applicable in the Kingdom of Saudi Arabia. You are bound by all its provisions and may not exclude any of them. If any provision of this Agreement conflicts with the binding legal provisions in your country of nationality, residence, or the territory from which you use the Platform, you must refrain from using the Platform or any of its Services. Accordingly, you shall not enter into this Agreement with us, and we shall not be obligated to comply with any legal provisions applicable in another country.

Access to Services

1. The User is responsible for obtaining all personal hardware, software, and other tools necessary to access and use Thatek’s Website and Applications, as well as for all related expenses, including Internet connection fees. Certain functions of the Applications require an active Internet connection, whether via Wi-Fi or a data network provider. In all cases, Thatek shall not be responsible for any malfunction or lack of full functionality of the Applications if you have no Internet connection or if the Applications are incompatible with your device’s operating system.
2. You agree to comply with all guidelines, notices, operating rules, policies, and instructions related to the use of the Services and the Platform, and you confirm that you have reviewed and accepted these documents before entering into this contractual relationship with us.

Services

Thatek is an e-platform that provides various services through the website and mobile applications, including these services (assessments in self-development, your tasks, interaction in society, and other new services), and all the services provided by the innovation and creativity of Thatek are the exclusive property of it, so you have no right to infringe on it in any way, whether by quoting, copying or imitating it for commercial or non-commercial purposes, otherwise you will be subject to legal accountability.

1. Assessments
   1. Thatek Platform helps you identify and develop your moral traits, self-confidence, and leadership skills through three professional assessments. Upon completion, your results and scores will be displayed to identify areas of strength and weakness.
   2. The content on Thatek Platform is categorized based on belief, gender, and age. We will continuously work to classify and enhance the content to improve the user experience and maximize user benefit.
   3. The content of the assessments currently aligns with Islamic beliefs and their sects. If your belief differs and you choose to proceed, you acknowledge that you may view content that may not align with your religious beliefs.
   4. You acknowledge and agree that a graduation certificate will be issued upon passing the developmental stage and completing all tasks in your developmental plan.
   5. You are responsible for the accuracy of the information you provide in the assessments. We do not guarantee the accuracy of results in case of false or incorrect data entry. Results are generated based solely on the information provided by the User.
   6. You acknowledge and agree that the accuracy of the assessment results represents Thatek’s best effort, subject to improvement, and depends primarily on the accuracy of your answers. Therefore, assessment results are provided for guidance purposes only, and the User bears full responsibility for reliance on them.
   7. You agree that Thatek Platform has the right to delete any points or rewards you have obtained if collected in a manner other than that specified by the Platform, and your account may be subject to suspension.
2. Paid Services
   1. Thatek Platform provides two types of accounts: the Basic Account (available to all users free of charge) and the Premium Account (a paid service with subscription plans).
   2. Thatek also offers two developmental programs for subscription: Self-Confidence, and Leadership Skills.
   3. Users may select the subscription plan that suits them—either the monthly package (one-month subscription) or the annual package (one-year subscription including a three-day free trial).
   4. Refund Period:
      1. Annual subscribers to the developmental programs may cancel their subscription during the three-day free trial period without any charges through the relevant application stores (Google Play or Apple Store).
      2. For Premium Account subscribers or developmental program participants, subscription refunds are subject to the refund policy of the application store (Google Play or Apple Store) through which the payment was made.

Legal Capacity

1. Our Services are not directed to individuals under the age of thirteen (13). The User therefore acknowledges having full and unrestricted legal capacity to enter into this Agreement with us or having the legal consent of a parent or guardian and not being affected by any conditions impairing legal capacity.
2. The Platform does not guarantee that each user of the Website and Mobile Applications is the person they claim to be, nor does it guarantee the verification of the eligibility of all users.
3. The User acknowledges entering into this Agreement at their own risk and assumes all responsibility and liabilities, including toward third parties, in the event of any violation.

Account and Usage Controls

1. Thatek is directed to English speakers to benefit from the services and assessments we provide; if you are a non-English speaker, you are responsible for the process of translating and using the content.
2. To benefit from most aspects of the Services provided by Thatek Platform, you must register an active personal account (the "Account"), and you agree to:
   1. Comply with and comply with all applicable laws, legislations, regulations and rules in the Kingdom of Saudi Arabia.
   2. Create a valid account, and agree to use the Platform for personal purposes only and in accordance with the applicable terms and conditions and any policies or guidelines provided by the Platform and subsequent modifications thereto.
   3. Provide us with the required data when filling out the registration form as well as login data through the Facebook and Google platforms, and this data must be complete, correct, accurate and current, and the obligation to update it whenever there are any changes, and to be responsible for any errors in it.
   4. Commit to maintaining the security and confidentiality of information related to the account, in particular the password, and not to disclose it and to restrict third parties from accessing the account.
   5. Acknowledge that the Account is personal, and assume all responsibilities and actions issued through the Account.
   6. You agree not to use the Account for illegal, fraudulent, inappropriate or offensive purposes for us, others, our brand or our services available through the Platform, and you agree not to engage or assist others in any activities that impede the functioning and operation of the Website, applications or services.
   7. You have never been suspended or prevented from using the Service at any time.
   8. agree not to provide any part of the Service to any other parties or allow them to access; modify, disable or interfere with the Service, or support servers or networks in any way.
   9. Notify Thatek of any illegal or unauthorized use or in the event that the account is compromised.
3. You know that third parties may share the provision of services with us such as the platform for registering your account on Thatek platform or in which you share assessment results (such as X, Facebook, Google, Apple), video viewing sites such as YouTube and any other sites visited through the Thatek platform (links sources and references); and therefore you agree that the terms and conditions, privacy policy, and cookie policies of these parties will apply to you, in addition to these terms and conditions. and the policies of Thatek platform.
4. DHATEC has the right to refuse or cancel the registration of any user, ban any user from using the site, terminate your account and reject any/all current or future uses at any time in the following cases:
   1. If it is proven that you have provided information that is incorrect, inaccurate, not current or incomplete.
   2. If you are proven to be using the Account in a manner that violates the terms, policies, rules and guidelines of the Platform.
   3. If your actions are found to have caused any damages, losses or liability to us or any other user.
   4. If it is proven that any user has mistreated, whether verbal or written, towards any user, consultant, employee, member or administrator.
   5. If we see any other violations in any other circumstances, as the platform management deems appropriate.

Licenses to Use

1. The Platform grants you a limited, non-exclusive, non-sublicensable, irrevocable, non-transferable or sub-license license to access and use the Platform and Services or any content, information or related materials through the Services solely for your personal purposes, and accordingly the use of our Services for commercial purposes is prohibited in any way.
2. The rights granted to you in these Terms are subject to the following limitations; You may not:
   1. license, sell, rent, transfer, assign, distribute, host or exploit the Service.
   2. modify, copy, adapt, translate, merge, disassemble, extract source code, reverse engineer any part of the Website or Applications, make any derivative versions of the Applications, or reformat or frame any part of the pages comprising the Website or Apps;
   3. Access the Service, Platform or Applications in order to create similar or competing Services.
   4. remove or destroy any proprietary logos or marks contained in the Website or Apps.
3. The licenses granted to you by Thatek shall expire if you do not comply with the terms and policies of the platform or any other terms or rules of operation published on the website or applications.
4. All rights not expressly granted to you in this Agreement are held by Thatek and its licensors, you are prohibited from assigning them to third parties or using any rights of us at any time without our express consent.

Code of Conduct

1. You may use Thatek and our Services only as legally permitted and in accordance with the terms of these Terms and Conditions, and you agree not to do any of the following:
   1. Post, upload, transmit, distribute, store, create or publish any inaccurate or misleading personal information.
   2. Post, receive, upload, download, use or reuse any material that does not comply with our approved content standards;
   3. Post spam or messages that support any illegal activities.
   4. post, broadcast, post or share any material containing viruses or any other malware (Trojans, Worms, Logic Bombs, Time Bombs, Keystroke Loggers, Spyware, Adware) or any other malicious code, files or computer programs designed to harm the normal operation of the Service (or any part thereof) or interfere with or identify them, or any other software or computer hardware.
   5. Post or share any defamatory, infringing, obscene, indecent or illegal material, information or expression, obscene or pornographic content, racist, derogatory, indecent, profanity, offending any other user or disrespecting the culture of others.
   6. cause any damage to the Service, Website, Applications or Trademarks in any way or infringe the rights of us or any third party;
   7. restrict or prevent any other user from using the Platform or attempting to use any account without the account owner's permission or obtaining another user's password or other personal information with false claims.
   8. Impersonate Thatek, one of its employees or any other user or entity;
   9. Attempt to interfere with the operation of the Applications or their functions, including, but not limited to, uploading, downloading or transferring corrupted files, computer viruses, electronic devices or other harmful material or using any software, procedures or devices with the aim of interfering with the operation of the Website or Applications.
   10. Use the Platform for any illegal or unlawful purpose or to violate any applicable law, regulations, regulations or rules.
   11. Upload or attach files containing software or other material protected by intellectual property laws unless the User owns the rights related to them or has obtained all necessary permissions in advance about them.
   12. Collect, track or disclose the personal information of users (our clients or advisors) for any reason including but not limited to email addresses and contact information.
   13. Attempt to gain unauthorized access to the Services or any networks, servers or systems connected to the Platform;
   14. Perform any act that would breach, erase or assessment any system or network, otherwise circumvent security measures or procedures for certifying or manipulating data, or accessing or tampering with the Services, the application system, the spaces of the programmers of Thatek or the computer systems of its suppliers.
   15. Transfer your account and username to another party without our consent.
2. You acknowledge and agree that failure by you to comply with any of the foregoing may result in the immediate termination of your Account or any services provided to you – with or without notice.

Payment methods, subscription system

1. Thatek Platform provides payment through the following methods: Visa, MasterCard, Mada, PayPal, Apple Pay, and In-App Purchase. Payment is made directly from the User’s account to Thatek Platform’s accounts, and the User must ensure that all payment-related information is correct, accurate, and valid before completing the payment process.
2. All transactions made via credit cards are due with immediate effect.
3. Thatek Platform, in cooperation with a payment gateway that provides technical security measures for the payment process to reduce the occurrence of electronic account hacking, reserves the right to refuse any payment transaction at any time if we believe that such transaction may lead to issues related to the hacking of bank accounts. However, we do not guarantee this and we bear no responsibility in case of any error made by the User during the payment process, nor do we bear any responsibility for hacking or fraud involving the cards used by the User online.
4. All information and data entered through the electronic payment gateway are encrypted for security protection, and all communications transmitted to and from the service provider’s website are also encrypted.
5. Thatek Platform offers weekly, monthly, and annual subscription plans for the Premium Account through in-app purchases, and the subscription begins once the initial payment is processed. The User’s subscription will be automatically renewed without notice until the User cancels it manually.
6. The User has the right to cancel the subscription at any time, and upon cancellation of auto-renewal, the User’s account will revert to the Silver Account after the subscription period ends.
7. Thatek Platform also provides monthly and annual subscription plans for the developmental programs. The monthly subscription begins immediately once the subscription fee is deducted upon completion of the payment process, and it is automatically renewed at the end of each monthly period if the subscription was made through the application store, unless the User disables auto-renewal from their store account settings before the renewal date.
8. For the annual subscription, the User receives a three (3)-day free trial starting from the subscription date, and the annual subscription fee will be automatically deducted after the end of the free trial unless the User cancels the subscription from the application store settings before the trial period ends.
9. All monthly and annual subscriptions made through the application stores are subject to the payment and refund policies of those stores (Google Play and Apple App Store), and they renew automatically unless canceled by the User in accordance with the procedures applicable in those stores.
10. Thatek Platform reserves the right to modify subscription prices or renewal terms for subscribers at each monthly or annual renewal cycle. The User will be notified of any price changes and will have the option to cancel the subscription.
11. In the event of a technical malfunction or temporary outage of the platform or application that prevents the User from accessing their developmental program and from interacting with their daily steps, we commit to compensating the User for the affected days by unlocking the corresponding developmental steps in full once the service resumes normal operation.
12. The number of unlocked steps will be calculated based solely on the days in which the User was unable to access the program due to a technical issue originating from the Platform, and only after verification by the technical support team.
13. This compensation does not apply to interruptions resulting from the User’s own internet outage, device malfunctions, or any reasons beyond the Platform’s control.

Surveillance

Thatek platform reserves the right, but is not obligated to do so, to monitor the service to determine compliance with the terms and conditions and any operating rules placed on the Sametak website and applications, and to comply with any system, law, regulation or any authorized government request, and reserves the right to remove any content at its sole discretion that violates the provisions of these terms or the obligations of the platform's licensors.

Security

1. Thatek platform relies on security standards (using hosting companies, electronic payment insurance companies, securing assessment results, and the platform as a whole) to counter acts of electronic hacking and database penetration; you expressly agree to the security standards that we follow in order to secure the site and your account with us.
2. You must take all reasonable care to ensure that your password and email are secure and not used by anyone else, and if your account password changes, you must follow the security standards approved by us and agreed to in advance.
3. You acknowledge that the DHATEC Platform is an Internet-based service, and that although we make every effort to keep the information secure, we cannot guarantee that the information received or transmitted by the User while using the Platform is 100% secure.

Intellectual Property Rights

1. We reserve all rights to the Service and all hardware, software and other elements used to provide the Service, our electronic system and assessments, and therefore it is prohibited to copy, imitate, modify, distort or perform any act that violates our financial or moral rights over any of them.
2. All rights in the Services and Content related to the DHATEC Platform (including but not limited to: text, forms, graphics, logos, button icons, images, audio and video clips, digital materials, documents, datasets, software, programming rights and other symbols contained therein (collectively, "Intellectual Property") You remain the property of the Platform or its licensors and are protected by international intellectual property or copyright rights and laws.
3. We reserve all intellectual property rights over the assessments, their content, presentation, and all information contained therein and their format; we will take all legal action in case of infringement.

Trademarks

1. Logos ("Thatek" and "Thatek"), trade names, page headers, custom graphics, button icons and domain names (collectively, the "Trademarks") are trademarks owned and registered in the name of the purposeful business organization, and any third party names, trademarks and service marks appearing on our Services are the property of their respective owners.
2. You may not use, copy, imitate or place any trademarks, patents, trade secrets, design rights, trade dress or logos anywhere for promotional purposes, intentionally or unintentionally, or on any content not owned by us without the prior official consent of the Sametak platform.
3. Any unauthorized use, copying, imitation or distortion of our trademark is a violation of our rights under trademark protection laws and therefore we reserve all our rights to seek appropriate compensation and to resort to criminal courts to impose penalties for infringement of trademark rights.

Legal Liability

1. You confirm that all information and data you provide to us is true, accurate and current, including payment information, and is at your own risk.
2. You are legally responsible in the following circumstances:
   1. Breach any provision of the terms and policies of the Platform of You, or use the Platform illegally, contrary to the purposes stated by us.
   2. You breach any of the laws in force in your country, without any legal liability (original, consequential, joint) on Thatek, its service providers, partners or employees.
   3. Use the Platform Services for purposes that expressly or implicitly conflict with the purposes of this Agreement, or in violation of applicable laws.
   4. Entering information on the Platform that is untruthful, non-conforming, inaccurate, or private to others, or violates any of the rights of others, such as the right to personal privacy, without any legal responsibility on the Platform.
   5. Cause the Platform itself or its service providers or employees any legal problems, or harm them in any way.
   6. Comply with any applicable third-party terms when using the Platform (for example, you must ensure that your use of the Platform does not violate your Mobile Device Agreement or any Internet Services Agreement).
3. You agree to:
   1. Pay any fees or amounts due to the Sametak platform.
   2. Comply with the restrictions on your use of the Platform as set out in these Terms.
   3. Exempting the platform from any legal or judicial claims in the event that the platform does not meet all your expectations, and if the content does not suit you, or does not achieve the desired results by subscribing to accounts or paid services through the platform.
   4. You take full responsibility for your use of the Platform and agree that any information you send or receive while using the Platform may not be secure and may be intercepted or accessed by unauthorized parties.
4. In all cases, we reserve the right to apply or limit the terms of exemption from liability contained in the sections, terms and paragraphs of these Terms, and the User acknowledges that he has read and accepted those terms before agreeing to this Agreement.

Legal Disclaimer

1. Unless expressly expressed in these Terms and to the extent permitted by law, we make no warranties or representations of any kind, either express or implied, with respect to Thatek or that the services available will meet your expectations and requirements, and the Platform and the content and information contained therein are provided on an "as is" or "as available" basis.
2. Thatek strives to do its best to ensure the availability of the Website and Applications for use, but it is not responsible for any possible interruption in the service due to, but not limited to, maintenance work, technical problems or other similar reasons, and does not bear responsibility for damages arising from the failure of the operation of the Platform.
3. Under no circumstances shall the Platform be liable for any direct, indirect, incidental, special, consequential, punitive, exceptional or any other damages whatsoever in connection with any use of the Platform including but not limited to:
   1. Any information, materials or recommendations related to the Platform or Consultations.
   2. Any matters beyond our control, including but not limited to the incorrectness or incompleteness of input data and information provided on third party websites that may be directly or indirectly linked to the Platform.
   3. Any loss arising from any matters beyond our control and unrelated to us, including malfunctions of equipment, electronic devices or communications (including computer, telephone and internet), illegal access, operation errors, or any other matters.
   4. Account security, confidentiality and privacy or disclosure of Account Login Details.
   5. Your contractual relationship with any third party service provider.
4. The use of information received or accessed by users through the DHATEC platform is the responsibility of both the persons who provide it or who use it.
5. Thatek will not be responsible for providing the Service on time in a complete and safe manner, or that the results obtained from these Services will be correct and reliable, or that the quality of the services provided will live up to your expectations.
6. Thatek will not be held responsible for any links to third-party websites accessible from the Website, or for any instructions provided therein or content for such websites.
7. Thatek does not warrant that the Site or their servers will be error-free without interruption, free from unauthorized access, or that any email sent from the Site is free of viruses or other harmful components.

Indemnification

By using our services and agreeing to these terms and policies, you agree to indemnify and hold harmless Thatek (by law), its affiliates and their partners, employees, directors, agents and suppliers from any and all claims, liabilities, liabilities, damages, losses, expenses and other expenses of any kind or nature (including legal fees and attorneys' fees), arising out of or in connection with:

1. Misuse of the Platform, or as a result of your illegal use of the Website and Applications of any kind.

When you use Thatek platform, send us an email, or communicate with us via phone, WhatsApp or through the Website and Applications, you communicate with us electronically and expressly consent to communicate electronically for the purposes of implementing the Services, whether through the Platform notices or through any means of communication provided to us.
2. We may send you or post notices about the Application or email on the Website in relation to legal disclosures such as changes to these Terms and Conditions, policies and other notices, legal communications and disclosures relating to the Services, you agree that all agreements, notices, disclosures and other communications that we provide to you electronically or by telephone meet all legal requirements as if such communications were in writing;
3. The user acknowledges and agrees by using the services to send Thatek platform notifications and messages to the e-mail provided by him and/or his record on the platform, for purposes related to the services of Thatek, including but not limited to reminders of consultation dates, notifications that must be notified to the user by law, and the introduction of some new features in applications or special offers and discounts, if you do not wish to receive such messages, you can unsubscribe from these messages at any time by clicking on the link Unsubscribe that appears at the bottom of each message, or by contacting us at our contact information.
4. Any notices you wish to send to the Platform must be sent through the means specified within the Platform, or through our telephone or e-mail numbers, and any notices sent to the contrary shall not be considered.

Amendments

1. The platform reserves the right from time to time to change, modify, supplement or remove parts of these terms without notifying you of these changes, and these terms will become effective when they are posted on the website and applications, and you agree that your continued use of the platform constitutes express acceptance of the modified terms, and you agree that the amended version supersedes all previous versions of these terms.
2. The Platform reserves the right to discontinue, modify or change any aspect of the Services Provided or any feature or function thereof at any time, and all rights, title and interests in the Service and its components (including all intellectual property rights) will remain exclusively owned by and belong to the Service, including but not limited to:

3. You are responsible for reviewing these Terms regularly so that you are aware of any changes to them and you will be bound by the new policy when you continue to use the Platform, and in the event that you do not accept the amended Terms, you must stop using the Services.

Term and Termination

1. These Terms shall remain in force while you access the Platform unless terminated by us or you, and we have the right in our sole discretion to suspend, restrict or terminate your access to the Platform with or without notice, and if we decide to do so, we will not bear any responsibility or obligations towards you or any other user in any way.
2. You may terminate the provisions of these Terms at any time by discontinuing to use the Services, and upon termination the rights and/or licenses granted to you in these Terms will cease unless notified otherwise.
3. The provisions of these Terms shall be terminated on their own initiative if your use of the Platform or Services causes any legal problems for us or third parties, or if you breach any provision of these Terms, or stop the activity of the Platform, and in all cases we have the right to recourse against you judicially if the reason for the termination is due to your breach of these Terms.

Applicable Laws and Jurisdiction

1. These Terms and other policies and subsequent amendments thereto are subject to the laws in force in the Kingdom of Saudi Arabia, and you agree that any disputes, claims or controversies arising out of or in connection with the Platform and the Service shall be the exclusive jurisdiction of the Saudi courts.
2. If any provision of these Terms is held to be illegal, void or unenforceable under the laws in force in the Kingdom in any jurisdiction, such clause shall be deemed severable from these Terms and shall not affect the legality, validity, validity and enforceability of the remaining Terms in any jurisdiction.

General Provisions

1.
