These supplemental terms, conditions and policies govern your access to the www.thatek.com website and applications of users and advisors on the Google Play and Apple Store stores ("Thatek, Thatek for consultants"), and your access to and use of content, services, assessments or consultations (the "Services").
2. Please read the terms, conditions, policies, rules and guidelines relating to your use of the Services (collectively, "Our Terms") to ensure that you understand each term before using Thatek Website and Applications as they affect your legal rights; by accessing or using any part of the Site, Applications or Services, you agree to be bound by these Terms, if you do not agree to the terms of these Terms and Policies and any subsequent amendments thereto, please do not access our Services.
3. Thatek platform reserves the right to modify, update or change these terms from time to time according to its sole discretion and according to its sole will, and you must review them on a regular basis to know any changes to them, and your continued use of Thatek site and applications and the services available through them is an express agreement to be bound by the amended and applicable terms at the time of your use of Thatek services, and you acknowledge our right to:

Definitions

5. "Laws": refers to the laws and regulations in force in the Kingdom of Saudi Arabia.

Legal nature of the Terms

1. This Agreement is a contract with full legal terms and elements in force against you, and once you use the Platform, it means that you have reviewed this agreement, and you are bound by it as you are bound by the contracts signed in writing.
2. Access to Services

The user is responsible for obtaining all special hardware, software and other tools necessary to access and use Thatek website and applications and all expenses related to this including Internet connection fees; as certain functions of the applications require the user to have an active connection to the Internet, whether the connection is via Wi-Fi, or by the data network provider, and in no case is the platform not responsible for the applications not working in full functionality if you do not have a connection Internet or incompatible with your device's operating system.
2. Services

Thatek is an e-platform that provides various services through the website and mobile applications, including these services (assessments in self-development, text and voice consultations, your tasks, interaction in society, and other new services), and all the services provided by the innovation and creativity of Thatek are the exclusive property of it, so you have no right to infringe on it in any way, whether by quoting, copying or imitating it for commercial or non-commercial purposes, otherwise you will be subject to legal accountability.

You agree that you may modify or change one of the services you lead, add or create new services.

1. Assessments
   1. The self-confidence / leadership skills platform helps you to identify and develop your self-confidence/leadership skills through two professional assessments and after completion, the result and points obtained by the user are displayed to know the strengths and weaknesses.
   2. The content on Thatek platform is categorized on the basis of gender and age; we will later seek to classify and develop the content that improves the user experience and maximizes the benefit to the user.
   3. You know and agree that the graduation certificate appears after passing the development stage and completing all tasks in your development plan.
   4. You are responsible for the correctness of the information you enter in the assessments; therefore, we do not guarantee the accuracy of the results in the event of entering information that is not truthful, or does not conform; in all cases, the results are produced based on the information provided by the user.
   5. You know and agree that the accuracy of the assessment results is the diligence of Thatek, which is scalable, and depends heavily on the accuracy of the choice of answers; therefore, the results of the assessments are provided to the User for indicative purposes, and therefore the User bears the result of relying on them.
   6. You agree that the platform has the right to delete the points and reward you have received if collected in a way other than that specified by the platform and your account will be subject to ban.
2. Your Consultations

   The Dhatec platform also provides consulting service according to the following:

   1. This service is used through Thatek applications for users and advisors, where Thatek platform acts as a channel of communication between the user and the advisor via messages or voice communication in these applications.
   2. The Advisor must read and agree to this Advisor Agreement along with these Terms and other policies applicable on Thatek before using the Services.
   3. The consultant can register an account through the consultants application, fill in the data according to qualification, specialization, number of years of experience, and schedule availability times to provide consultations (text or voice).
   4. Through the Your App the Advisor can search for the Advisor number or book directly with any Advisor.
   5. Text consultation is done by sending a message for one problem and is answered by the Advisor with a single message as there is no live written chat service between the User and the Advisor.
   6. The voice consultation takes place through the chat system adopted on the same platform between the advisor and the counselor, and the advisor has the right to terminate the consultation through the active button of the advisor in the advisors application without the users' application, with the exception of life plan consultations.
   7. The platform is committed to maintaining the privacy of its users, so no voice consultations are recorded or know what is going on between the client and the advisor during and after the voice consultation.
   8. The Advisor is committed to credibility when advising the Counselor, and both parties are committed to good conduct while providing the consultation.
   9. The User has the right to evaluate the service provided that the evaluation does not include writing obscene phrases, incitement to hatred, discrimination, violence, threats or other illegal behavior.
   10. In the event that the User does not receive the Consultation Service, the User has the right to retrieve the text or voice consultation to be able to request another consultation.
3. Paid Services
   1. Thatek also provides two development programs for participation (self-confidence and leadership skills).
   2. The user can choose the subscription package that suits him in the development programs, whether the monthly package (subscription for one month) or the annual package (subscription for a year including 3 days free trial).
   3. Return grace period:
      1. Subscribers of the Annual Development Programs Package can unsubscribe during the 3-day free trial period without deducting any money through the various application stores (Google Play or Apple Store).
      2. For subscribers to the monthly package of the Self-Confidence or Leadership Program, the refund of the subscription amount follows the refund policy of the App Store (Google Play or Apple Store) through which they were paid.

Legal capacity

1. Our Services are not directed to those under the age of thirteen (13 years old), so the User acknowledges that he has full and unrestricted legal capacity to enter into this Agreement with us or has the legal consent of a parent or legal guardian, and that he does not have any of the symptoms of eligibility.
2. The Platform does not guarantee that each user of the Mobile Website and Applications is the person claiming it, nor does it guarantee the verification of the eligibility of all users.
3. The User acknowledges entering into this Agreement with us at his own risk, liability and any other liability towards third parties in case of violation.

Account and Usage Controls

1. Thatek is directed to English speakers to benefit from the services and assessments we provide; if you are a non-English speaker, you are responsible for the process of translating and using the content.
2. To benefit from most aspects of the Services provided by Thatek Platform, you must register an active personal account (the "Account"), and you agree to:

4. DHATEC has the right to refuse or cancel the registration of any user, ban any user from using the site, terminate your account and reject any/all current or future uses at any time in the following cases:
   1. If it is proven that you have provided information that is incorrect, inaccurate, not current or incomplete.
   2. If you are proven to be using the Account in a manner that violates the terms, policies, rules and guidelines of the Platform.
   3. If your actions are found to have caused any damages, losses or liability to us or any other user.
   4. If it is proven that any user has mistreated, whether verbal or written, towards any user, consultant, employee, member or administrator.
   5. If we see any other violations in any other circumstances, as the platform management deems appropriate.

Licenses to Use

1. The Platform grants you a limited, non-exclusive, non-sublicensable, irrevocable, non-transferable or sub-license license to access and use the Platform and Services or any content, information or related materials through the Services solely for your personal purposes, and accordingly the use of our Services for commercial purposes is prohibited in any way.
2. The rights granted to you in these Terms are subject to the following limitations; You may not:
   1. license, sell, rent, transfer, assign, distribute, host or exploit the Service.

Code of Conduct

1. You may use Thatek and our Services only as legally permitted and in accordance with the terms of these Terms and Conditions, and you agree not to do any of the following:

   2. Post, receive, upload, download, use or reuse any material that does not comply with our approved content standards;

   15. Transfer your account and username to another party without our consent.
2. You acknowledge and agree that failure by you to comply with any of the foregoing may result in the immediate termination of your Account or any services provided to you – with or without notice.

Payment methods, subscription system

1. Thatek platform provides payment through the means: Visa – Master Card – Mada – PayPal – Apple Pay – In-App Purchase.
2. Payment is made directly from the User's account to the accounts of the Sametak platform, and the User must ensure that the information related to the payment is true, accurate and valid before completing the payment process.
3. All Credit Card transactions shall be due with immediate effect.
4. Thatek platform in cooperation with a payment gateway that provides technical means of security for the payment process to reduce the phenomenon of hacking electronic accounts, and therefore we reserve the right to refuse any payment transaction at any time, if we believe that such process may cause problems related to hacking bank accounts, but we do not guarantee this and do not bear any responsibility in the event of an error by the user in the payment process, nor do we bear any responsibility as a result of hacking or fraud on his used cards. 5. All information and data you enter through the electronic payment gateway are encrypted for the purpose of security protection, and correspondence circulating to and from the service provider's website is also encrypted.

Surveillance

Security

Thatek platform relies on security standards (using hosting companies, electronic payment insurance companies, securing assessment results, and the platform as a whole) to counter acts of electronic hacking and database penetration; you expressly agree to the security standards that we follow in order to secure the site and your account with us.
2. You must take all reasonable care to ensure that your password and email are secure and not used by anyone else, and if your account password changes, you must follow the security standards approved by us and agreed to in advance.
3. You acknowledge that the DHATEC Platform is an Internet-based service, and that although we make every effort to keep the information secure, we cannot guarantee that the information received or transmitted by the User while using the Platform is 100% secure.

Intellectual Property Rights

1. We reserve all rights to the Service and all hardware, software and other elements used to provide the Service, our electronic system and assessments, and therefore it is prohibited to copy, imitate, modify, distort or perform any act that violates our financial or moral rights over any of them.
2. All rights in the Services and Content related to the DHATEC Platform (including but not limited to: text, forms, graphics, logos, button icons, images, audio and video clips, digital materials, documents, datasets, software, programming rights and other symbols contained therein (collectively, "Intellectual Property") You remain the property of the Platform or its licensors and are protected by international intellectual property or copyright rights and laws.

Trademarks

1. Logos ("Thatek" and "Thatek"), trade names, page headers, custom graphics, button icons and domain names (collectively, the "Trademarks") are trademarks owned and registered in the name of the purposeful business organization, and any third party names, trademarks and service marks appearing on our Services are the property of their respective owners.
2. You may not use, copy, imitate or place any trademarks, patents, trade secrets, design rights, trade dress or logos anywhere for promotional purposes, intentionally or unintentionally, or on any content not owned by us without the prior official consent of the Sametak platform.
3. Legal Liability

   6. Comply with any applicable third-party terms when using the Platform (for example, you must ensure that your use of the Platform does not violate your Mobile Device Agreement or any Internet Services Agreement).
3. You agree to:
   1. Pay any fees or amounts due to the Sametak platform.
   2. Comply with the restrictions on your use of the Platform as set out in these Terms.
   3. Exempting the platform from any legal or judicial claims in the event that the platform does not meet all your expectations, and if the content does not suit you, or does not achieve the desired results by subscribing to accounts or paid services through the platform.
   4. You take full responsibility for your use of the Platform and agree that any information you send or receive while using the Platform may not be secure and may be intercepted or accessed by unauthorized parties.
4. In all cases, we reserve the right to apply or limit the terms of exemption from liability contained in the sections, terms and paragraphs of these Terms, and the User acknowledges that he has read and accepted those terms before agreeing to this Agreement.

3. Under no circumstances shall the Platform be liable for any direct, indirect, incidental, special, consequential, punitive, exceptional or any other damages whatsoever in connection with any use of the Platform including but not limited to:
   1. Any information, materials or recommendations related to the Platform or Consultations.
   2. Any matters beyond our control, including but not limited to the incorrectness or incompleteness of input data and information provided on third party websites that may be directly or indirectly linked to the Platform.
   3. Any loss arising from any matters beyond our control and unrelated to us, including malfunctions of equipment, electronic devices or communications (including computer, telephone and internet), illegal access, operation errors, or any other matters.
   4. Account security, confidentiality and privacy or disclosure of Account Login Details.
   5. Your contractual relationship with any third party service provider.
4. The use of information received or accessed by users through the DHATEC platform is the responsibility of both the persons who provide it or who use it.
5. Thatek will not be responsible for providing the Service on time in a complete and safe manner, or that the results obtained from these Services will be correct and reliable, or that the quality of the services provided will live up to your expectations.
6. Thatek will not be held responsible for any links to third-party websites accessible from the Website, or for any instructions provided therein or content for such websites.
7. Thatek does not warrant that the Site or their servers will be error-free without interruption, free from unauthorized access, or that any email sent from the Site is free of viruses or other harmful components.

Indemnification
